Terms and conditions
These terms apply when you create a Vitalis account or use the service at vitalisemr.com. Vitalis is operated by Mahima Kollebailu Raghavendra ("we", "us"). By creating an account you agree to them.
1. What Vitalis is
Vitalis is software for clinics to keep patient records, write prescriptions, manage appointments and billing, and share information with patients. It is a record-keeping tool. It does not give medical advice, diagnose, or replace a doctor's judgement.
2. Who can use it
Vitalis is for registered medical practitioners and the clinic staff they authorise. You confirm that the details you give, including your medical registration number, are true, and that you will keep your password private. You are responsible for everything done under your account and the reception logins you create.
3. Your responsibilities as the doctor
- You decide what to record, and you are responsible for the clinical content, its accuracy, and your treatment decisions.
- You act as the data fiduciary for your patients' data under the Digital Personal Data Protection Act, 2023. You must get consent from patients (or from a parent or guardian for a child) before entering their data. Vitalis provides tools to record consent.
- You must follow the laws and medical regulations that apply to you, including record keeping and prescription rules.
- Do not misuse the service: no unlawful use, no attempts to access other clinics' data, no interfering with the service.
4. Records and the 24-hour lock
A saved visit can be changed or deleted for 24 hours. After that it is locked, and corrections are made by a new entry. Activity on records is logged. This protects the integrity of medical records.
5. Free trial, subscription and payment
- New accounts get a 90-day free trial.
- After the trial the price is ₹4,500 per year, GST included. Current prices are always on the pricing page.
- Payments are handled by Cashfree. One payment buys 12 months of access. The plan does not renew automatically; you pay again when you choose to renew. You receive a GST tax invoice by email after each payment.
- If a trial ends or a subscription lapses, you can still view your records, but adding new patients, visits and invoices is paused until you subscribe.
- Price changes. Your price is guaranteed for two years from the day you start paying. We review prices at most once every two years, and we give you at least 30 days' notice before a change applies to you. You can choose not to renew.
6. Ending your plan and refunds
Your plan ends at the end of the paid year unless you renew. There is nothing to cancel because nothing renews by itself. Fees already paid are not refunded, except duplicate or failed charges. See the refund and cancellation policy.
7. Your data
Your clinic's records belong to you. We process them only to provide the service, as described in the privacy policy. You can export your data, and you can ask us to delete your account. We keep backups for a limited period for recovery.
8. Availability
We work to keep Vitalis available and your data safe, but we cannot promise it will always be uninterrupted or error-free. Keep your own regular backup using the export feature.
9. Limit of liability
To the extent the law allows, we are not liable for indirect or consequential loss, or for clinical decisions made using the service. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.
10. Ending the service
You may stop using Vitalis at any time. We may suspend an account that breaks these terms or the law, after giving notice where possible.
11. Changes to these terms
We may update these terms. We will post the new version here with its date, and for material changes we will tell you in the app or by email.
12. Governing law
These terms are governed by the laws of India. The courts at Bengaluru, Karnataka have jurisdiction.
